Fixed-Term Rental Contracts Legislation

Contract

Starting July 1, 2024, fixed-term rental contracts will be the standard for all landlords. This applies to both self-contained living spaces and non-self-contained living spaces (rooms). The Fixed-Term Rental Contracts Act aims to better protect tenants. However, there are still opportunities for landlords to enter into temporary rental agreements.

According to the new law, landlords can still enter into a fixed-term rental agreement (for a maximum of two years) under the following circumstances:

  • Students who temporarily rent in another municipality for their studies, different from where they live;
  • People who, due to work or renovations on their own home, need to temporarily live elsewhere;
  • Couples who are going through a divorce, no longer live together, and temporarily rent a property to be closer to their children.

Additionally, landlords can still enter into a rental agreement with a tenant that is "short-term by nature." Case law shows that for a rental agreement to be considered “short-term by nature,” the temporary nature of the rental must be in the interest of both the landlord and the tenant. Therefore, renting a property for a short period is still possible in certain specific cases.

You can think of the following target groups:

  • People who need to temporarily leave their home due to fire or water damage;
  • People who are between two homes, looking for temporary accommodation;
  • Foreign companies that need to house their staff in the Netherlands temporarily for a project;
  • Tourists (for example, through Airbnb).

In addition, owners of vacation homes or 'aparthotels' can also temporarily rent out their properties.

Own property

Temporarily Renting Out Your Own Property?

Another option is temporarily renting out your OWN property when you go abroad for work, vacation, or studies. This is known as "interim renting" or the diplomat clause. Your tenant will leave the property when you return. Clear agreements should be made with the tenant regarding this. Expats, for example, often take advantage of this arrangement as they frequently relocate abroad for work.

VAT-Taxed 'Short Stay' Rentals

We specialize in renting properties under the VAT scheme. In this case, your property is rented out for short stays of up to 6 months. The main advantage of this setup is that you are eligible for a significant VAT refund. It’s important to seek proper advice from your tax advisor and also inquire with your local municipality about the available options.
